A remarkable case, indeed. On discussing the prosecution of the young musicians from St. Petersburg, both media and commentators unanimously claim that the drawing up of a second charge under Article 20.3.3 of the Code of Administrative Offences of the Russian Federation, on discrediting the use of the army, makes them liable for an immediate criminal charge under Article 280.3 of the Criminal Code of the Russian Federation, which provides for punishment for repeated “discreditation.”
These articles of the CAO RF and the CC RF both, of course, contradict the Constitution, and no one should be prosecuted under them, and the wonderful young people, naturally, have done nothing that would give any grounds for any prosecution whatsoever.
But no! It is currently impossible to charge them under Article 280.3, Part 1, CC RF on the basis of a “repeat offence”. A repeat offence requires that the second violation under administrative law be committed within a year after the decision in the first such case entered into legal force.
Unfortunately, when it comes to individual administrative-law penalties, lawless judges can impose a separate punishment on the young people for every performance of every song – even for each individual verse. But no matter how many such administrative charges there are, none of them can turn into a criminal case. An unlawful criminal case for repeated “discreditation” can be initiated only for new songs performed after their release from custody.
This is an obvious mechanism, applicable to any criminal article that provides for an administrative preclusion, and there have been quite a few of them since 2012. And I think any lawyer would know this.
The repressive reality in Russia is already horrific as it is, and it certainly does not need to have its horror compounded by erroneous assertions about threats.

Since, as it turns out, some Western politicians do not believe that it’s possible in Russia to be given eight years in prison for a social media post about the Bucha massacre, we have selected from our database those whom we know for certain have received real prison sentences specifically for such posts on social media. This is obviously not an exhaustive list, as it is far from always known for which specific war crimes a person was convicted based on their posts, and such information is not always available in our database, not to mention that the list does not include those who were convicted in absentia.
