Law of the Week: Article 280.1 of the Russian Criminal Code (Public calls for actions aimed at violating the territorial integrity of the Russian Federation)

On Monday, 24 August 2020, a Russian military court sentenced Airat Dilmukhametov, a prominent opposition activist from the Bashkortostan region, to nine years in a high-security prison on extremism charges under Article 280.1, Part 2, of the Russian Criminal Code. Dilmukhametov has been recognised by Memorial Human Rights Centre as a political prisoner.

Article 280.1. Public calls for actions aimed at violating the territorial integrity of the Russian Federation

(introduced by Federal Law dated 28.12.2013 N 433-FZ)

1. Public calls for actions aimed at violating the territorial integrity of the Russian Federation are punishable by a fine of 100,000 to 300,000 roubles or the sum of the wages or other income of the convicted person for a period of one to two years, or forced labor for up to three years, or detention for a period of four to six months, or imprisonment for up to four years with deprivation of the right to hold certain positions or engage in certain activities for the same period of time.

2. The same acts committed with the use of mass media or electronic or information and telecommunication networks (including the Internet) shall be punished by obligatory work for up to 480 hours with deprivation of the right to hold certain positions or engage in certain activities for up to three years or deprivation of liberty for up to five years with deprivation of the right to hold certain positions or engage in certain activities for up to three years.
