Week-ending 2 July 2021

This week the European Court of Human Rights issued five judgments with regard to Russia finding violations of Convention articles 2 (right to life), 3 (prohibition of torture), 5 (liberty and security of person), 6 (fair trial), 8 (private and family life) and 10 (freedom of expression).

A violation of Article 2 of the Convention under its procedural limb; the respondent State is to pay the applicants jointly, within three months, the following amounts: (i) EUR 15,000 (fifteen thousand euros), plus any tax that may be chargeable, in respect of non-pecuniary damage, to be converted into the currency of the respondent State at the rate applicable at the date of settlement; (ii) EUR 3,600 (three thousand six hundred euros), plus any tax that may be chargeable to the applicants, in respect of costs and expenses, to be converted into pounds sterling at the rate applicable at the date of settlement and to be paid into the representative’s bank account in the United Kingdom.
MANOLE AND POSTICA v. THE REPUBLIC OF MOLDOVA AND RUSSIA
A violation of Article 5 § 1 of the Convention by the Russian Federation; a violation of Article 5 § 4 of the Convention by the Russian Federation; the Russian Government is to pay the applicants, within three months, the following amounts: (i) EUR 3,000 (three thousand euros) each, plus any tax that may be chargeable, in respect of non-pecuniary damage; and (ii) EUR 1,500 (one thousand five hundred euros) jointly, plus any tax that may be chargeable to the applicants, in respect of costs and expenses.
A violation of Article 3 of the Convention on account of the applicant’s routine handcuffing; a violation of Article 6 of the Convention on account of the applicant’s absence from civil proceedings; a violation of Article 8 of the Convention on account of the lack of confidentiality of telephone conversations between the applicant and his representatives; the respondent State is to pay the applicant, within three months, EUR 900 (nine hundred euros) in costs and expenses, to be converted into the currency of the respondent State at the rate applicable at the date of settlement, plus any tax that may be chargeable.
ȘCERBININA v. THE REPUBLIC OF MOLDOVA AND RUSSIA
A violation of Article 6 § 1 of the Convention by the Russian Federation; the Russian Federation is to pay the applicants, within three months, the following amounts: (i) EUR 3,000 (three thousand euros), plus any tax that may be chargeable, in respect of non-pecuniary damage, to each applicant; (ii) EUR 1,600 (one thousand six hundred euros), plus any tax that may be chargeable to the applicants, in respect of costs and expenses, to each applicant.
A violation of Article 10 of the Convention; the respondent State is to pay the applicants, within three months from the date on which the judgment becomes final in accordance with Article 44 § 2 of the Convention, EUR 7,500 (seven thousand five hundred euros) each, plus any tax that may be chargeable, in respect of non-pecuniary damage, to be converted into the currency of the respondent State at the rate applicable at the date of settlement.
