Week-ending 5 November 2021

This week in four rulings the European Court of Human Rights found violations of Convention Articles 2 (right to life), 3 (prohibition of torture), 6 (fair trial), 8 (respect for family and private life), 11 (freedom of assembly and association) and 13 (right to an effective remedy).
A violation of Article 11 of the Convention in respect of the first applicant; violations of Articles 3, 8 and 13 in respect of the second applicant; the respondent State is to pay the second applicant, within three months, EUR 7,500 (seven thousand five hundred euros), plus any tax that may be chargeable, in respect of non-pecuniary damage, to be converted into the currency of the respondent State at the rate applicable at the date of settlement.

A violation of the procedural aspect of Article 2 of the Convention; the respondent State is to pay the applicant, within three months, the following amounts, to be converted into the currency of the respondent State at the rate applicable at the date of settlement (i) EUR 15,000 (fifteen thousand euros), plus any tax that may be chargeable, in respect of non-pecuniary damage; (ii) EUR 3,152 (three thousand one hundred and fifty-two euros), plus any tax that may be chargeable, in respect of costs and expenses.
Decides to revise its judgment of 11 February 2020; Decides to strike the application out of the list in so far as the complaint by Mr Aleksandr Ivanovich Boyarishchev is concerned.
