ECtHR ruling of the Week: In Belskiy and Others v. Russia, the ECtHR found violations of Article 3, Article 5 and Article 13

This week there was one ruling handed down by the European Court of Human Rights regarding Russia. In Belskiy and Others v. Russia, the Court found violations of Article 3 (prohibition of torture), Article 5 § 3 (excessive length of pre-trial detention), Article 5 § 4 (excessive length of judicial review of detention) and Article 13 (lack of an effective remedy in domestic law).


BELSKIY AND OTHERS v. RUSSIA, 25 February 2021

The complaints disclosed a breach of Article 5 § 3 of the Convention concerning the excessive length of pre-trial detention; there has been a violation of the Convention as regards the other complaints raised under well-established case-law of the Court (see appended table) namely violations of Article 3 (prohibition of torture), Article 5 § 4 (excessive length of judicial review of detention) and Article 13 (lack of an effective remedy in domestic law); the respondent State is to pay the applicants, within three months, the amounts indicated in the appended table, to be converted into the currency of the respondent State at the rate applicable at the date of settlement.
